19 січня Європейський парламент більшістю голосів ухвалив резолюцію на підтримку створення спеціального міжнародного трибуналу для переслідування злочину агресії росії проти України.
“Європейський парламент підкреслює необхідність та невідкладність лідерства європейських інституцій та країн-членів у створенні спеціального додаткового трибуналу для засудження злочину агресії проти України, що був скоєний політичним та військовим керівництвом РФ та її союзників та вважає, що такий трибунал має бути заснований на основі міжнародної угоди між країнами-однодумцями, за підтримки Генеральної Асамблеї ООН”, – йдеться у документі.
У цьому контексті депутати привітали пропозицію президента Єврокомісії Урсули фон дер Ляйєн щодо утворення спеціального трибуналу для засудження злочину агресії проти України.
Європарламент вважає, що створення спеціального трибуналу заповнить велику прогалину в поточній інституційній структурі міжнародного кримінального правосуддя та має ґрунтуватися на стандартах і принципах, які застосовуються до Міжнародного кримінального суду та Римського статуту.
Європейські політики закликали ЄС та його країни-члени, у взаємодії із партнерами та регіональними організаціями, такими як Рада Європи, утворити “коаліцію доброї волі” для здійснення міжнародного правосуддя та просування у боротьбі з безкарністю Росії за скоєння агресії.
Європарламент вважає, що спеціальний міжнародний трибунал повинен мати юрисдикцію для переслідування не лише путіна та політичного і військового керівництва рф, але й лукашенка та політичного і військового керівництва білорусі як держави-співучасниці, з території якої і за матеріально-технічної підтримки якої рф веде свою агресивну війну проти України.
Спеціальний трибунал має доповнювати зусилля МКС та його прокурора з розслідування звинувачень у геноциді, воєнних злочинах та злочинах проти людства, що були скоєні в Україні. Цей спеціальний трибунал має тісно співпрацювати з МКС та розміщуватися у Гаазі. Створення такого міжнародного трибуналу за участю України, на думку депутатів, має розпочатися негайно.
“Європейський парламент твердо переконаний, що утворення цього спеціального трибуналу для засудження злочину агресії надішле дуже чіткий сигнал для російського суспільства та до міжнародного співтовариства, що путін і російське політичне та військове керівництво можуть бути засуджені за злочини, що були скоєні в Україні. А також стане сигналом для політичної та ділової еліти росії, що повернення росії до “бізнесу як завжди” із Заходом за лідерства путіна є неможливим”, – йдеться у документі.

On January 19, European Parliament by a majority of votes adopted a resolution in support of the creation of a special international tribunal to prosecute the crime of russian aggression against Ukraine.
“European Parliament emphasizes the necessity and urgency of the leadership of European institutions and member states in creating a special additional tribunal to condemn the crime of aggression against Ukraine, which was committed by the political and military leadership of the russian federation and its allies, and believes that such a tribunal should be established on the basis of an international agreement between like-minded countries, with the support of the UN General Assembly,” the document states.
In this context, the deputies welcomed the proposal of the President of the European Commission, Ursula von der Leyen, to establish a special tribunal to condemn the crime of aggression against Ukraine.
European Parliament believes that the creation of a special tribunal will fill a major gap in the current institutional structure of international criminal justice and should be based on the standards and principles that apply to the International Criminal Court and the Rome Statute.
European politicians called on the EU and its member states, in cooperation with partners and regional organizations such as the Council of Europe, to form a “coalition of goodwill” to implement international justice and advance the fight against russian impunity for aggression.
European Parliament believes that a special international tribunal should have jurisdiction to prosecute not only putin and the political and military leadership of russia, but also lukashenko and the political and military leadership of belarus as a participating state, from whose territory and with whose material and technical support russia conducts its aggressive war against Ukraine.
The special tribunal should complement the efforts of the ICC and its prosecutor to investigate allegations of genocide, war crimes and crimes against humanity committed in Ukraine. This special tribunal should work closely with the ICC and be based in The Hague. The creation of such an international tribunal with the participation of Ukraine, according to the deputies, should begin immediately.
“European Parliament is firmly convinced that the creation of this special tribunal to try the crime of aggression will send a very clear signal to russian society and to the international community that putin and the russian political and military leadership can be tried for the crimes committed in Ukraine. And it will also be a signal to the political and business elite of russia that russia’s return to “business as usual” with the West under Putin’s leadership is impossible,” the document says.
